Executive Order 202.40 Notes Changes in Staff Testing for Regions in Phase II

The NYS Governor just released Executive Order 202.40, extending the requirement for nursing home and assisted living staff testing through July 9th, 2020. The modifications of clauses contained in Executive Order 202.30 are amended only to the extent that the operator and administrator of all nursing homes and all adult care facilities, which are located in regions that have reached Phase Two of reopening, must test or make arrangements for the testing of all personnel, including all employees, contract staff, medical staff, operators and administrators, for COVID-19, once per week.

HHS Releases $15 Billion for Medicaid Provider Relief

HHS announced distribution of an additional $15 billion specifically for Medicaid providers who have not yet received funding from the Provider Relief Fund general allocation. These providers would include Assisted Living communities, other home and community-based service providers, as well as Medicaid-only SNFs.

Below is the AHCA bulletin with further details on accessing the relief funds:

AHCA/NCAL has advocated for the last several weeks for HHS to make provider relief payments to Medicaid providers. Today, June 9, HHS announced the distribution of $15 billion from the Provider Relief Fund to Medicaid providers. These additional resources are critical for providers. We also know that more is still required to ensure the safety of our residents and staff. We’ll continue to advocate on your behalf for the funds and other resources you need.  

Eligible providers include Medicaid and Children’s Health Insurance (CHIP) providers that participate in state Medicaid and CHIP programs and have not previously received a payment from the Provider Relief Fund General Allocation.

MLTC Transition to FFS

DOH held a conference call earlier today to announce the implementation of the MLTC-FFS three-month benefit limitation, which is now scheduled to take place effective 8/1/20. Attached is the sample “Notice of Long-Term Care Medicaid Plan Disenrollment” which will be sent to SNF residents. DOH has contacted the MLTC plans with a listing of residents whose “chronic care budget is complete” with the goal of processing that batch of residents by the 8/1/20 disenrollment date. The disenrollment notice additionally provides the ability for residents and/or their families to assess their possible return to the community. If so notified, DOH would remove those residents from the initial disenrollment batch.

A DAL is expected to be issued either later today or tomorrow which will provide administrators a template to provide data on potential residents who may qualify for a return to the community. Responses to DOH will be due by next Tuesday, June 16, 2020.

DOH is not yet proceeding with having the MLTC plans initiate disenrollments, as additional guidance will be forthcoming. NYSHFA reminded DOH of the importance of messaging the timing of the NAMI collections to the MLTC plans with respect to the 8/1/20 disenrollment date.
